15.       Discussion and possible action for the approval of the Mutual Cooperation Agreement between the City of Del City and Oklahoma County pursuant to Title 69, O.S.   1903 (B)and Title 11, O.S.   36-113(D) for road improvements associated with the reconstruction of Sunnylane Road from Reno Ave to 4th in Del City. Upon completion, the Municipality shall reimburse the County for material, labor and equipment costs in an amount not to exceed $42,747.32. This Agreement shall become effective upon adoption and shall terminate on June 30, 2016. Requested by Willa Johnson, County Commissioner, District No. 1, and approved as to form and legality by Gretchen Crawford, Assistant District Attorney. (Document Received)

 

16.       Discussion and possible action for the approval of the Mutual Cooperation Agreement between the City of Del City and Oklahoma County pursuant to Title 69, O.S.   1903 (B)and Title 11, O.S.   36-113(D) for road improvements associated with the reconstruction of Sunnylane Road from Reno Ave south to I-40 in Del City. Upon completion, the Municipality shall reimburse the County for material, labor and equipment costs in an amount not to exceed $57,391.09. This Agreement shall become effective upon adoption and shall terminate on June 30, 2016. Requested by Willa Johnson, Commissioner, District No. 1, and approved as to form and legality by Gretchen Crawford, Assistant District Attorney.

 

17.       Discussion and possible action to approve the Demolition Contract between Midwest Wrecking Company and the Board of County Commissioners for Oklahoma County Project No. E-2008-D, Demolition and Removal of Properties for Crutcho Park Acquisition Project CDBG 1. The total amount of the contract shall not exceed $66,370.00.  This Agreement is eligible for funding pursuant to the contract between Oklahoma County and Oklahoma Department of Commerce, as approved by the Board of County Commissioners on February 2, 2015. Payments are to be made only from monies made available to the Oklahoma Department of Commerce (ODOC) by the U.S. Department of Housing and Urban Development (HUD) for the CDBG-Disaster Recovery Program. Upon receipt of invoice, Oklahoma County will request funds from ODOC. Once funds are deposited to County Bond Fund/Crutcho Project (20323130), Oklahoma County will encumber and pay vendor the approved amount. Whetsel,   et al.  CIV-14-1030-HE, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest.

 

c.         Pursuant to 25 O.S. 307 (B) (4) to engage in confidential communications between the public body and its attorney concerning a pending investigation, claim or action in BOCC v. Oklahoma City SMSA Tower Holdings, CV-15-1364, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest.

 

d.       Pursuant to 25 O.S. 307 (B) (4) to engage in confidential communications between the public body and its attorney concerning a pending investigation, claim or action in BOCC v.TLW Properties, CV-15-1947 and CV-15-1949 and BOCC v. TLW-SDW LLC, CV-15-1948, and where on advice of its attorney, the board has determined that disclosure will seriously impair the ability of the public body to process the claim or conduct a pending investigation, litigation, or proceeding in the public interest.
